The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 363 and 366/34 of the Indian Penal Code.
Allegation has been made that the wife of the informant was missing and she was allegedly taken away by Amit Kumar @ Amit Raj. The victim is married lady and she has stated in the statement made under Section 164 of the Code of Criminal Procedure that she entered into face-book friendship with Amit Kumar @ Amit Raj and he took her forcefully to Mumbai through airways and she remained in the hotel. There he has taken objectionable photographs and wanted to sale her. Only
Patna High Court Cr.Misc. No.36751 of 2018 (2) dt.29-06-2018 2 /2 allegation has been made against the petitioner to be associated with Amit. There is no direct allegation against the petitioner inasmuch as the victim has gone through the airways itself shows the consent of the lady with Amit Kumar @ Amit Raj. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Sunny Kumar @ Sunny Kumar Kasera, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Danapur in connection with Bihta P.S. Case No.13 of 2018, G.R. No. 55 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/- U T
