The petitioner is apprehending his arrest in connection with Raniganj P.S.Case No.178 of 2019 registered for offences punishable under Sections 406, 409, 420 of the Indian Penal Code.

As per FIR, petitioner was given Rs.16,63,710/- for flood relief work but in spite of the information, he has not returned the same .

Submission of the learned counsel for the petitioner is that during the flood relief work, he has distributed rice to the tune of Rs.19 lac and now Rs.02 of the petitioner is due with the authority concerned and when he has given notice about the same, the present case has been lodged.

Heard learned A.P.P. also.

No.73242 of 2019(2) dt.19-11-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below within a period of three weeks from the date of receipt of the order and on surrender he will be released on provisional bail in connection with Raniganj P.S.case No.178 of 2019 till submission of the charge-sheet with further condition that he has to appear before the I.O. and produce all the papers in support of his submission as made above, which will be inquired by the I.O. and if the case is found true by the I.O., the petitioner has to surrender and pray for regular bail, which will be considered on the basis of the materials available at that time.

With the aforesaid direction, this application is disposed of.
