JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 417/420 of the Indian Penal Code.
Prosecution case is that this petitioner cheated son of the complainant by executing sale deed of others land and thereafter they agreed to return the consideration money and also executed an agreement in this regard but they did not return the consideration money.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is no way concerned with the agreement as the same was executed by Manish Paswan. Petitioner never cheated
Patna High Court CR. MISC. No.664 of 2023(2) dt.24-03-2023 2/2 son of the informant and he has not received any money from the complainant. Besides this, petitioner only executed the piece of land on which he had right and title. Petitioner has got no criminal antecedent.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Darbhanga in CR No.1291 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
