02. In the present case, the petitioners are apprehending their arrest in connection with Panjwara P.S. Case No. 40 of 2021, registered on 23.04.2021, for the alleged offence under Sections 341, 323, 308, 504, 506 and 34 of the Indian Penal Code.

03. As per prosecution case, the allegation against the petitioners and other co-accused person is that of assaulting the informant and his wife, causing injuries to them.

04. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.82459 of 2023(2) dt.10-01-2024 2/3 petitioners are innocent and have been falsely implicated in this case. The occurrence took place over a minor dispute between parties and quarrel over playing of child of the informant. The allegations are general, omnibus and non-specific. The injury report of the victim shows superficial bruise and superficial cut injury and the injuries are simple in nature. The petitioners have got no criminal history.

05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering simple nature of injuries in the background of minor dispute, let the petitioners above named, in the even of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial in connection with Panjwara P.S. Case No. 40 of 2021 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions: (i) One of the bailors will be a close relative of the petitioners.
