2. The petitioner apprehends his arrest in connection With Kochas PS Case No. 264 of 2024 for the offence punishable under Sections 8(e), 20(B)(2)(B)22(b)/29, NDPS Act lodged on 20.08.2024 by the informant, Vijay Baitha.
3. As per the prosecution story, the informant alleged that on secret information about selling of 'ganja' by the accused, place was raided and there is recovery of 12 kgs. of 'ganja' which led to the FIR.
4. Learned counsel for the petitioner submits that his name has come in the confessional statement of the apprehended accused persons and one Vivek Kumar has been
Patna High Court CR. MISC. No.80612 of 2024(3) dt.28-02-2025 2/2 granted bail by this Court in Cr. Misc. No. 82281 of 2024.
5. Learned APP opposes the prayer submitting that not only his name has come in the confessional statement, he has criminal antecedent and further Vivek Kumar has been granted bail and not anticipatory bail.
6. Taking into account the aforesaid facts/submissions as also that the petitioner has criminal antecedent, it would be appropriate that he seeks bail.
7. The present petition for anticipatory bail stands rejected.
8. However, if the petitioner surrenders within four weeks from today and file bail application, the same shall be considered and disposed of, if possible, on the same day. (Rajiv Roy, J) perwez U T
