The petitioner seeks pre-arrest bail in connection with Chautham P.S.Case No. 66 of 2018 registered under Sections 406 & 409 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that on vague allegation of irregularity in purchase of solar lights without specifying as to what irregularity was committed the petitioner has been made accused in the F.I.R along with 26 others. It is further submitted that some of the other coaccused having identical allegations have already been granted pre-arrest bail by this Court.
Considering the nature of allegation and the
Patna High Court Cr.Misc. No.36128 of 2018 (2) dt.03-07-2018 2/2 submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Choutham P.S.Case No. 66 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
