Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 379, 354B, 504 and 34 of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 25-5-2024 at 2 am, while she was sleeping on the roof, when petitioner climbed on roof and came on her roof and slept beside her and started acting inappropriately, on alarm the petitioner started abusing and assaulted her and fled snatching her mangalsutra and payal, further when she came down stairs

Patna High Court CR. MISC. No.78781 of 2025(2) dt.04-12-2025 2/3 along with her family members, they saw broken lock of Almiraha and Rs. 10,000 was missing, further father and sister of petitioner are also involved in the occurrence. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that a specific pleading has been made at para-11 of the anticipatory bail application that petitioner and the informant are agnates and at para-18, it has been pleaded that informant is aunt of the petitioner and the family is having dispute relating to land as would manifest from annexure-2 to the anticipatory bail application. It is also submitted that informant has even tried to falsely implicate the father and sister of the petitioner. It is next submitted that informant in the FIR has concealed the fact that petitioner is related to her.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

No.78781 of 2025(2) dt.04-12-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 568 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
