1. The present writ petition has been filed seeking the following reliefs:- "1. That this application is being filed for issuance of a writ in the nature of Mandamus commanding the Respondent authorities to initiate an encroachment proceeding against the encroachers / private Respondent 4 & 5 who have illegally encroached the public lands bearing Khata No. 290/291, Khesara No. 1761/1879 and Khesara No. 1754, 1758, 1762, 1763, 1767 respectively total area 2.36 acres situated at village Dhadhaur of Anchal Sikandra in the District of Jamui.

1/A. That the petitioner further prays for issuance of an appropriate writ commanding the Respondent

Patna High Court CWJC No.2057 of 2023(2) dt.26-09-2023 2/2 authorities to remove the illegal encroachment from the aforesaid public lands (as mentioned in Para no.

1) which have been illegally occupied by the private Respondents 4 & 5 by making construction over the same."

2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Sikandra, District-Jamui, for redressal of his aforesaid grievance. Liberty so sought is granted.

3. It is needless to state that in case the petitioner approaches the Circle Officer, Sikandra, District-Jamui, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

4. The writ petition stands disposed off on the aforesaid terms.
