The petitioner is in custody in connection with Parwalpur P.S. Case No. 39 of 2018 for the offence registered under Sections 379, 431 of the Indian penal Code, Section 4/40 of the Bihar Mines and Minerals Rule 1972 and under Section 8(d) of the Bihar Illegal Minerals Act, 2003. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that the petitioner is a driver of tractor which was allegedly used for carrying sand and he was not known about the valid challan and G.P.S. installed in tractor.
