The petitioners apprehend arrest in a case registered under Sections 406, 420/34 of the Indian Penal Code. The prosecution case in brief is that the accused persons in the name of constructing house took loan of Rs. 4.5 lac from the informant and later on, the same was not returned and grabbed by them.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering alleged against the petitioners. It is alleged that the petitioners had taken money for construction of

Patna High Court CR. MISC. No.68796 of 2019(2) dt.16-11-2019 2/2 house and the same is not being returned. Hence the present case has been lodged. There is no documentary evidence to suggest that the petitioners had taken any money from the informant.

On behalf of the state, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 651 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
