2. Both the accused/petitioners are named in the FIR and apprehending their arrest in connection with Dagarwa P.S. Case No. 275/2025 registered under Sections 64, 126(2), 115(2), 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.').
3. Considering the submissions as advanced by learned counsels that on face of FIR itself suggests that the rape as alleged was committed by the named co-accused Saddam, where implications of these petitioners appear only out of their relation mainly with co-accused Saddam and against them the allegations of rape is not available, accordingly, the petitioners,
Patna High Court CR. MISC. No.74952 of 2025(2) dt.04-11-2025 2/2 above-named, are directed to be released on bail, in the event of their arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna, in connection with Dagarwa P.S. Case No.275/2025, subject to the conditions as laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
