JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mohiuddin Nagar P.S. Case No. 69 of 2019, registered for the offences punishable under Sections 302, 363, 201, 34 the Indian Penal Code.

As per F.I.R the informant has suspected that his daughter along with his three children were killed by the coaccused and further stated that this petitioner assisted in the concealing the dead body.

Submission of the learned counsel for the petitioner is that even according to F.I.R there is no allegation against this petitioner and he has been made accused in this only on suspicion.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub-Divisional Judicial Magistrate, in connection with Mohiuddin Nagar P.S. P.S. Case No.-69 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that petitioner co-operate in the investigation and appear as and when required.
