The petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is not named in the FIR whereas some others are named in the FIR of the occurrence of murder. Name of the petitioner surfaced during investigation on the basis of identification in CCTV footage. The petitioner is in custody since 19.08.2015. Some other co-accused who was named in the FIR, have already been allowed bail by different coordinate Benches of this Court.
Earlier prayer for bail of the petitioner was refused by this Court on 22.06.2018 vide order at Annexure-1.
Patna High Court CR. MISC. No.75690 of 2019(4) dt.05-03-2020 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.366 of 2017, arising out of Kadam Kuan P.S. Case No.367 of 2015, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
