The petitioner, in the present case, is seeking regular bail in connection with Barun P.S. Case No.97 of 2018, registered for offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504 and 120B of the Indian Penal Code and Section 3/4 of the Prevention of Damage of Public Property Act, 1984.
It is submitted on behalf of the petitioner that the petitioner has been falsely implicated by police on mere suspicion. There is no specific allegation against him and altogether 87 persons are named in the FIR. The alleged occurrence had taken place when a procession of the villagers indulged in brick-batting and throwing
Patna High Court Cr.Misc. No.37271 of 2018 (2) dt.29-06-2018 stones in the market. They were agitating against the death of a boy who had met with an accident. It is further submitted that the co-accused has been granted bail by this Court in Cr.Misc.No.37364 of 2018.
Learned APP for the State is present.
Considering the facts and circumstances whereunder there is no specific allegation against this petitioner and the co-accused has been granted bail, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 97 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
