Learned counsel for the petitioner has submitted that petitioner is ready to deposit the amount whatsoever collected by him along with others on the false pretext of providing service in a Bandhan Bank. Learned counsel for the petitioner further submits that, for the present, he is able to deposit Rs. 3 Lacs and the rest amount, petitioner undertakes to deposit in installments within six months. Till then, petitioner be allowed to avail provisional bail. Also submitted that the aforesaid deposit should not be treated/considered/presumed to be adverse to his interest.
On deposit of Rs. 3 Lacs, petitioner, NIRANJAN KUMAR NIRAJ is directed to be released on provisional bail
Patna High Court CR. MISC. No.69704 of 2019(6) dt.03-06-2020 2/2 till 03.12.2020 on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon PS Case No. 486/2017 corresponding to G.R. No. 4516/2017. In case, remaining amount is deposited, then in that event, the learned lower court will confirm the provisional bail, otherwise, will pass appropriate orders, in accordance with law. The learned lower court will also ensure genuineness, authenticity and soundness of the bailors before acceptance of the bail bond.
