Petitioner, already in custody, seeks bail in connection with S. Tr . No.516 of 2012 arising out of Isuapur P.S. Case No.95 of 2011 registered under Sections 302/34 of the Indian Penal Code.

This is the third time seeking prayer of bail by the petitioner. Twice it was rejected on merit. Allegation against this petitioner is that he stabbed on the chest of the deceased resulting into his death.

Learned counsel for the petitioner submits that the petitioner has been in custody since 16.11.2011 and still the trial has not been concluded, the last witness was examined on 16.03.2016. However, the report of the trial court indicates that

Having considered the aforesaid facts and circumstances, as the trial is at the fag end, the prayer of the bail of the petitioner is again rejected and the trial court is directed to conclude the trial after examination of the I.O and take all steps to procure his attendance.

Let a copy of this order be sent to the Superintendent of Police, Saran also in order to secure the appearance of the I.O of the case for giving deposition at the earliest. (Arun Kumar, J) S.KUMAR/- U T
