JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 10.3.2018, seeks bail in Bakhtiarpur PS Case No. 216 of 2017 registered under Sections 304(B), 328 and 34 of the IPC.

The allegation in brief is that there was strange relationship between the petitioner and his wife so his wife was living with her maternal grand-father, the petitioner along with his brother went there and after one hour left the in-law's place, the informant found his grand-daughter in unconscious condition and after treatment she died.

Learned Counsel for the petitioner submits that there was strange relationship between the two, his wife was living with her4 material grand father where she died and after 15 days of the death the petitioner has falsely been implicated in this case, the post mortem report does not indicate any antimortem injury over the body, cause of death was not ascertained and the viscera was preserved. It is also submitted that the daughter-in-law of the informant was informed by the informant that the petitioner's wife had taken poison.

Patna High Court Cr.Misc. No.31430 of 2018 (3) dt.20-07-2018 Having considered the said facts and circumstances, the petitioner, namely, Chhotu Yadav @ Chhotelal Yadav @ Chhote Lal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Saharsa in connection with Bakhtiarpur PS Case No. 216 of 2017.
