The petitioners seek regular bail in connection with Motipur P.S. Case No.213 of 2018 for the offences punishable under Section(s) 272, 273 IPC and 30(A), 38(i) & 41 of the Bihar Prohibition and Excise Act, 2016..

The allegation is regarding the recovery of 3290.04 liters of illicit liquor from the truck.

The learned counsel for the petitioners submits that the petitioners are driver and Khalasi of the said truck. It is further submitted that the petitioners are neither the owner nor the consignor of the loaded truck, hence the said recovery of illicit

Patna High Court Cr.Misc. No.31765 of 2018 (2) dt.31-05-2018 2/2 liquor cannot be attributed to them. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 25.03.2018.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Muzaffarpur in connection with Motipur P.S. Case No. 213 of 2018.
