The petitioner seeks bail in Rosera P.S. Case No. 98 of 2018 registered under Sections 153(A), 295(A), 504, 506 of the Indian Penal Code.
Petitioner along with other accused persons had tried to spoil the communal harmony by hurling shoe and sleeper on the procession of Goddess Durga.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no concern with the aforesaid occurrence. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has been falsely implicated in this case due to dirty village politics. The
Patna High Court Cr.Misc. No.31521 of 2018 (02) dt.24-05-2018 - 2 - identity and genuineness of the source of information has not been mentioned in the written report. The petitioner has been languishing in custody since 27.03.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Rosera, District Samastipur in connection with Rosera P.S. Case No. 98 of 2018.
