JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-06-2018 The petitioner is husband of the deceased. He has been made accused in connection with Bagaha (Pathkhauli) P.S. Case No. 488 of 2016 which was initially instituted for the offences under Section 302, 201/34 of the Indian Penal Code, but later, Section 304(B) of the Indian Penal Code was also added.
The prayer for bail of the petitioner was earlier rejected vide order dated 12.01.2018.
The learned counsel for the petitioner has submitted that despite the petitioner having remained in jail for a substantial period, the trial has yet not commenced. I am not inclined to grant bail to the petitioner for the present. However, the Trial Court is directed to conclude the
Patna High Court Cr.Misc. No.32358 of 2018 (2) dt.20-06-2018 2/2 trial as early as possible.
The petition is dismissed with the aforesaid observation.
