The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

As per prosecution case, informant alleged that on 19.06.2022, her daughter was killed by the petitioner along with other co-accused persons due to non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Peittioner is father-in-law of the deceased due to which he has falsely been implicated in this case. There is no specific allegation of dowry demand against the petitioner rather it is a general and omnibus

Patna High Court CR. MISC. No.1730 of 2023(2) dt.05-04-2023 2/2 allegation against all the accused persons along with this petitioner. He has no concern mess and business with the deceased as well as her husband and living separately from both of them. The husband of the deceased has the main responsibility to keep his wife with proper honour and dignity. It is further submitted that the petitioner has no criminal antecedent moreover he is languishing in judicial custody since 28.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sahebganj P.S. Case No. 274 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur.
