2. In the present case, the petitioner seeks bail in connection with Sonpur P.S. Case No. 533 of 2025, dated 02.06.2025, registered for the offences punishable under Sections 126(2), 115(2), 303(2), 109, 352, 351(2) & 3(5) of the B.N.S.

3. As per the prosecution case, petitioner and other coaccused persons entered into the house of the informant and assaulted her and took her away Rs. 2,000/- and a gold earring from the informant. They also threatened the informant to do away with the life of son of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

Patna High Court CR. MISC. No.75003 of 2025(2) dt.21-11-2025 2/3 been implicated in the present case. There is case and counter case and the co-accused Akbar Ali has lodged Sonpur P.S. Case No. 534 of 2025 against the informant side as the informant side assaulted the co-accused with iron rod causing fracture on his head and hand. No visible injury was found on the informant except pain in the lower abdomen and backache. This falsifies the allegation of making any attempt on life of the informant. The F.I.R. has been lodged after delay of two days without any satisfactory explanation. The petitioner is in custody since 04.06.2025 having clean antecedent. Charge-sheet has been submitted.

5. Learned A.P.P. appearing on behalf of the State opposed the submission of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of injury, charge-sheet has been submitted and period of custody, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of court of learned Chief Judicial Magistrate, Saran at Chapra/concerned court, in connection with Sonpur P.S. Case No. 533 of 2025, subject to the condition laid down under

Patna High Court CR. MISC. No.75003 of 2025(2) dt.21-11-2025 3/3 Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
