The petitioner seeks bail in connection with Phulkaha P.S. Case No. 151 of 2019 (Special Case No. 1278 of 2019), registered for offence punishable under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that nothing has been recovered from the conscious possession of the petitioner and he has no concern with the alleged recoveries. The petitioner has no criminal antecedent and he is in custody since 23.09.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.74793 of 2019(3) dt.03-12-2019 2/2 and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Phulkaha P.S. Case No. 151 of 2019 (Special Case No. 1278 of 2019).
