2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 303 ( 2 ), 317 ( 2 ), 61 ( 2 ) and 3 (5) of BNS.
3 . As per F.I.R on 20.06.2025 , informant seized a vehicle while stolen construction material was being loaded on it.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Petitioner has been made accused in this case because the said vehicle was seized in front of the shop of this petitioner. Petitioner is neither owner nor driver of seized vehicle and has
Patna High Court CR. MISC. No.75305 of 2025(2) dt.10-12-2025 2/2 got no concern with the alleged recovery . No incriminating article has been recovered from possession of petitioner. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Saran at Chapra in connection with Dighwara P.S. Case No. 238 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
