Nobody appears on behalf of opposite party no. 2, despite ordinary notice having been received by him personally.

The petitioners seek bail in anticipation of their arrest in connection with Kamtaul P.S. Case No. 108 of 2019 dated 23.07.2019 instituted for the offences under Sections 341, 323, 307, 366(A)/34 of the Indian Penal Code.

No.68523 of 2019(7) dt.06-12-2021 2/3 The accusation against the petitioners is that they had abused and assaulted the parents of the girl, who had gone to them to complain that the son of the petitioner no. 1 had been stalking his daughter. Learned counsel for the petitioners has submitted that the son of petitioner no. 1 has been granted anticipatory bail by the court below on the ground that the daughter of the opposite party no. 2 has already married with him, out of her own volition, which fact has been reiterated in the 164 Cr.P.C. statement of the victim girl. The victim girl has disclosed her age to be 19 years.

Apart from this it has been submitted that the petitioners being mother, sister and younger brother of the person who has married the daughter of the opposite party no. 2, they had no control over Suraj Ram, son of petitioner no. 1.

Considering these aspects of the matter, the petitioners were granted provisional bail by order dated 27.09.2021.

There is nothing on record to indicate anything otherwise.

Considering the aforestated fact, the provisional bail granted to the petitioners by order dated 27.09.2021 is, hereby, confirmed.
