2. The petitioner has prayed for bail in connection with Fesar P.S. Case No.88 of 2024 registered for the offence punishable under Sections 126(2), 115(2), 352, 118(2), 119(2) and 3(5) of Bhartiya Nyay Sanhita and Sections 25(1-B)a, 26 and 27 of the of the Arms Act.

3. The case of the prosecution is that the petitioner has fired with his katta on Manish Kumar which hit in stomach.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has falsely been implicated in this case. There is also a counter version of this case and in that case, Binod Kumar Singh the

From perusal of the injury report of Manish Kumar, it transpires that he has received firearm injury. Petitioner is languishing in judicial custody since 23.08.2024.

5. The application for bail is opposed by learned APP for the State and submitted petitioner is having criminal antecedent of four cases.

Having heard learned counsel for the parties and considering the fact that since there is case and counter case and petitioner has also received injuries, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Aurangabad in connection with Fesar P.S. Case No. 88 of 2024. (Ashok Kumar Pandey, J) lata/- U T
