The petitioners in the present case are seeking regular bail in connection with Ayar P.S. Case No.72 of 2019 registered for the offence punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Learned counsel submits that there is no specific allegation of assault against these petitioners.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case

No.74937 of 2019(2) dt.11-12-2019 2/3 wherein it appears from the submission of learned counsel for the petitioners that though these petitioners are named in the FIR amongst seven persons who are said to have assembled at the door of the informant and had asked him not to lay bricks on the said piecce of land but there is no specific allegation that these petitioners were carrying any arm and/or that they had either fired and assaulted the informant and his uncle even otherwise and further that these petitioners have remained in custody since 30.08.2019 and the investigation against them is complete, let the petitioners above named be released on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Bhojpur at Ara in connection with Ayar P.S. Case No.72 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C. as under:

(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing
