====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is languishing in custody since 06.08.2019 in a case registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code.
The prosecution case got initiated on the basis of written report of Amit Kumar submitted before the Station House Officer, Rajgir Police Station to the effect that the informant purchased the land appertaining to Khata No. 12, Plot No.319, situated at Mauza- Mahadevpur, Ward No.8, P.S. - Rajgir, total area 10 decimals through registered sale deed on 28.06.2019 and

No.75231 of 2019(4) dt.19-03-2020 2/3 12.07.2019 from one Manas Prakash and when the informant went to get the land mutated, he came to know that he has purchased the said land from a person who is not the actual owner of the land in question. Subsequently, the informant contacted the person from whom he had purchased the said land and came to know that the petitioner impersonated Manas Prasad and executed the sale deed of the land in question. Thereby, the petitioner cheated the informant by impersonating Manas Prasad and took altogether Rs. 43,60,000/- from the petitioner for transfer of the land in question.
It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present case. Moreover, even assuming the accusation to be true, the only offence under Section 419 of the I.P.C. is made out and apart from the present case, the petitioner is accused in one other case of similar nature.
Learned APP for the State submits that there is specific accusation against the petitioner in the FIR and he is accused in one other case of similar nature.
Considering the civil nature of dispute and the investigation being already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
