The petitioners apprehend their arrest in Dharhara P.S. Case No.04/2015 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
The petitioners are alleged to have assaulted the informant. The petitioner no.1 Bablu Yadav is said to have assaulted with iron rod on his head.
Learned counsel for the petitioners submits that police after investigation submitted final form finding the case true only under Section 341, 323 and 504/34 of the Indian Penal Code but the learned Magistrate took cognizance of the offence under
Patna High Court Cr.Misc. No.34137 of 2018 (2) dt.28-06-2018 2/2 Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. The injuries found on the person of the informant are simple in nature.
Considering the aforesaid fact and the nature of allegation made against the petitioner, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt Angira Kumari, J.M.1st Class, Munger, in connection with Dharhara P.S. Case No.04/2015, corresponding to G.R.No. 50/2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
