The petitioner apprehends his arrest in Goraul P.S. Case No. 331 of 2022, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner assaulted the informant with iron rod and also outraged the modesty of the wife of informant.

It is submitted that both parties are own brothers and there is pending land dispute for which a partition suit bearing Partition Suit No. 293/2010 and Title Suit No. 06/2018 are pending between them. Petitioner claims clean antecedents. Counsel for informant however, vehemently opposed

Patna High Court CR. MISC. No.5197 of 2023(2) dt.09-05-2023 2/2 the prayer for bail and submitted that injuries caused by the petitioner was found to be grievous in nature. Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
