JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-10-2023 It appears from the statements made in paragraphs '8' and '9' of the counter affidavit filed on behalf of respondent no. 2 that after investigation of the case, inspection of the place of occurrence and upon recording of the statements of the victim girl under Section 164 Cr.P.C., the case has been found under the category of mistake of facts. As per the supervision report, Final Form No. 30 of 2023 dated 21.02.2023 has been submitted as mistake of facts in connection with this case.

Having regard to the aforesaid stand, nothing survives for adjudication in the present writ application. It is being disposed of as having become infructuous.
