2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 366(a)/34 of the I.P.C.
3. The case of the prosecution is that the minor daughter of the informant, Ani Kumari has gone with one Pinki Kumari. When she did not return for a considerable time, she was being searched. One Rahul Kamkar told that one Gopal Kamkar has taken away Pinki Kumari two months earlier.
4. Learned counsel for the petitioner submits that the during course of investigation Pinki Kumari and Ani Kumari
Patna High Court CR. MISC. No.79153 of 2024(3) dt.25-02-2025 2/2 both have given their statement under Section 164 Cr.P.C. wherein they have stated that they have gone to Ara Station with this petitioner and after that they have gone to hyderabad with one Nandu. The role of this petitioner is that he had taken the victims to Ara Station, nothing else. The petitioner is having no criminal antecedent and he is in judicial custody since 13.07.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bahoranpur P.S. Case no. 21 of 2024 on furnishing bail bond of rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learnedA.C.J.M. VII, Bhojpur at Ara.
7. Accordingly, the present bail application stand allowed.
