The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 341, 323, 354B/376/511/509/34 of the Indian Penal Code.

Prosecution case in short is that while the informant was sitting at her home, the accused persons including the petitioner came there and forcibly dragged the informant and her mother from the house with intent to commit rape with her.

Patna High Court CR. MISC. No.69467 of 2019(4) dt.03-06-2020 2/3 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 28-06-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case due to land dispute. The allegation, made in the FIR is denied by the petitioner. The other co-accused with similar allegation has been granted anticipatory bail by a coordinate bench of this court vide order dated 21-092019 passed in Cr. Misc. No. 66164 of 2019. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 154 of 2019.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection
