====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The complainant and several others had deposited money to get better return in Idol India Corporations Limited. When the money was not returned on maturity, the investors found themselves cheated.

Submission is that the petitioner has no direct concern with the said company, rather he is Director of Universal Micro Credit Company Limited and there is no evidence that the petitioner directly induced the complainant or any other person

Patna High Court CR. MISC. No.78796 of 2019(2) dt.04-12-2019 2/2 to deposit money in the Idol India Corporations Limited. Learned counsel for the complainant opposed the prayer for bail on the ground that Universal Micro Credit Company Limited is sister concern of Idol India Corporations Limited and, in fact, the petitioner is promoter of Idol India Corporations Limited.

Considering the fact that there is no direct material against the petitioner of involvement, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No. 380(C) of 2017, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
