The petitioner is languishing in custody since 15.06.2019 in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code. It is alleged against the petitioner that on the pretext of assisting the informant in withdrawing money he exchanged his ATM card with that of informant and subsequently, fraudulently withdrew Rs.28,500/-.

It is submitted by learned counsel for the petitioner that the accusation has been levelled merely on suspicion and investigation has already been concluded. However, the petitioner is accused in two other cases but the same were registered on the basis of suspicion only.

Learned APP submits that the accusation is specific

Patna High Court CR. MISC. No.69388 of 2019(2) dt.27-11-2019 2/2 against the petitioner.

Considering the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Udakishunganj, District - Madhepura in connection with Bihariganj P.S. Case No. 06 of 2019.
