Petitioner in the present case is seeking a direction to the respondent authorities to take a decision on his application for appointment as Chaukidar/ Dafadar.

Learned counsel for the petitioner submits that the father of the petitioner was working as Chaukidar and was given compulsory retirement in the year 2014 because of his physical appearance. Learned counsel, however, submits that the said compulsory retirement was not challenged. One year after the said retirement, this petitioner filed an application seeking appointment on compassionate ground.

Learned counsel submits that so far as the Bihar

Patna High Court CWJC No.2228 of 2023(2) dt.19-04-2023 2/2 Chaukidar Cadre (Amendment) Rules, 2014 is concerned, the rule does not provide for any such claim for appointment. It is admitted that in law the petitioner has no right to claim such appointment.

Mr. Irshad, learned counsel for the State is present. In view of the admitted position that the petitioner has no right to claim appointment on the post of Chaukidar after compulsory retirement of his father, this writ application is dismissed.
