2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 413, 414, 420, 467, 468, 471 of the Indian Penal Code.

3. The allegation against the petitioner is that from his house a stolen motorcycle has been recovered and also from the house of other co-accused persons.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. He submitted that the father of the co-accused namely, Khobari Sah is the owner of the said motorcycle bearing Registration No. BR-22C-8218, which he has purchased it from one Rameshwar Sharma. He further submitted that no complaint has been made

Only on the basis of suspicion and misinformation, petitioner has implicated in the present case by the police. He further submitted that the other co-accused has already been granted bail by this Bench vide order dated 08.09.2023 passed in Cr. Misc. No. 59343 of 2023. He is languishing in judicial custody since 29.06.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 508 of 2023.
