===================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 The petitioners seek bail in connection with Tikkari P.S. Case No. 284 of 2017 dated 09.07.2017instituted for the offences under Sections 302, 201, 120(B) of the Indian Penal Code.

The brother of the deceased has lodged the F.I.R that the deceased was not treated well in her matrimonial home and his brother-in-law (husband of the deceased) does not have a good moral character. On 08.07.2017, the informant was told by somebody of his village that his sister has been done to death. It was, therefore suspected by him that all the family members of the husband of the deceased have killed

Patna High Court Cr.Misc. No.39613 of 2018 (2) dt.09-07-2018 2/3 her and have caused the disappearance of the dead body. The learned counsel for the petitioners has submitted that the marriage of the deceased took place twelve years ago and the relationship had not been cordial. This was particularly because of the inter-se dispute between the spouses. So far as the petitioners are concerned, one is the elder brother whereas the other is younger brother of the husband of the deceased. Both of them stay separately and are not concerned with the day-to-day affairs of the deceased and her husband. But for a suspicion in the mind of the informant that because of the relationship of the petitioners with the husband of the deceased, they too might have participated in her killing, it has been argued, there is no other material to connect the petitioners with the crime. The petitioners are in custody since 06.05.2018 and the father-in-law of the deceased has been granted bail by a Bench of this Court vide order dated 13.12.2017 passed in Cr. Misc. No. 56023 of 2017.

Regard being had to the aforesaid facts, the petitioners above named, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in
