2. The petitioner is apprehending arrest in connection with Barhariya P.S. Case No. 241 of 2023 instituted under Sections 341, 323, 504, 498A, 506/34 of the Indian Penal Code lodged on 22.06.2023 by the informant, Kumud Lata.

3. As per the prosecution story, the informant alleged that she got married to the petitioner four years ago but once in her in-laws' house, a demand of Scorpio Car was made. The family members of the informant were not in a position financial to provide the said vehicle, both mental and physical harassment took place. The father of the informant tried his level best to come to an amicable settlement but he was also abused on 20.05.2023. Later, it is alleged that after abusing her, the mother-in-law gave order whereafter she was beaten by the

Patna High Court CR. MISC. No.77973 of 2023(7) dt.18-10-2024 2/2 petitioner and his family members. The husband also tried to strangulate her, as a result of which, she became unconscious. She anyhow, rushed to her room, locked it from inside, called the police, got rescued and taken to the parents' home. This followed the FIR.

Though the allegation that has come in the FIR is grave and it was only after the police reached the spot that she could be rescued, both the coordinate benches as also this Court tried their best to let the petitioner realize that having married the lady, either she should be kept with all due respect in his house or they should come to an amicable settlement.

5. The petitioner despite having assaulted the lady and the process continued if the FIR is to be believed, chose to look the other way and this Court is of the opinion that the mental harassment of the lady is still continuing.

6. In that background, it would be appropriate that the petitioner seek bail. The anticipatory bail application stands rejected. The interim protection granted on 05.07.2024 stands withdrawn.
