Petitioner is in custody in connection with Turkauliya P.S. Case No. 104 of 2018 for the offence under sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that in the instant case two persons were made accused in connection with seizure of 30 liters of liquor. He submits that petitioner has no criminal antecedent. He further submits that similarly circumstanced other co-accused namely, Brajesh Ram has been granted bail by a coordinate bench of this court in Cr. Misc. No. 23573 of 2018 vide order dated 26.4.2018 and one Bhagat
Patna High Court Cr.Misc. No.38103 of 2018(2) dt.29-06-2018 2/2 Mahto was granted anticipatory bail vide order 25.4.2018 in Cr. Misc. No. 23865 of 2018.
In view of the above, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge cum Special Judge Excise, East Champaran, Motihari, in connection with Turkauliya P.S. Case No. 104 of 2018.
