ANJANA MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 27.07.2019 in connection with Chhatapur P.S. Case No. 439 of 2017 registered for the offence punishable under Sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that though he is not named in the FIR, his name surfaced in the confessional statement of co-accused Vimal Paswan which has no evidentiary value. It is further submitted that nothing was recovered from the conscious possession of the petitioner nor has he been placed on the T.I. Parade.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.69972 of 2019(2) dt.18-11-2019 2/2 with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Supaul, in connection with Chhatapur P.S. Case No. 439 of 2017.
