2. The petitioner apprehends his arrest for the offences alleged under Sections 498(A) and 304(B)/34 of the Indian Penal Code, registered in connection with Khanpur P.S.Case No. 105 of 2024.

3. According to allegation, the marriage of the deceased was solemnized with co-accused Krishna Kumar @ Krishna Kumar Sah on 12.12.2019. The informant, who is father of the deceased, gave customary presents as per his affording capacity. The deceased went to her matrimonial home with her husband and gave birth to a female child. After the birth of the female child, the accused persons started torturing/tormenting her and also demanded dowry and also threatened to kill her.

The learned counsel for the petitioner has submitted the husband of the deceased Krishna Kumar @ Krishna Kumar Sah has been granted bail by a co-ordinate Bench of this Court in Cr.Misc.No. 8509 of 2025. So far as the present petitioner is concerned, he is the brother of co-accused Krishna Kumar and for this reason, he has falsely been implicated in the present case. It is also submitted that the petitioner is living separately with Krishna Kumar, having no concern with day-to-day affairs of the couple and merely because he is a family member of Krishna Kumar, he has been falsely implicated. It is next submitted that the family members of the deceased were present at the time of cremation about which they were informed by the members of the defense side about the death of the deceased.

5. The husband of the deceased has been granted bail in Cr.Misc.No. 8509 of 2025. The petitioner is dewar (brotherin-law) of the deceased supposed to have no concern with the day-to-day affairs of the couple.

6. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of

No.79613 of 2024(7) dt.09-09-2025 3/3 this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Samastipur in connection with Khanpur P.S.Case No. 105 of 2024, subject to the conditions as laid down under Section 438(2) Cr. P.C./482(2) of the BNSS,2023.
