The petitioner, who is in custody, seeks bail in connection with Andhratharhi P.S. Case No. 114 of 2016 registered for the offence punishable under Section 379 of the Indian Penal Code.

Informant in his written complaint has stated that he had purchased the motorcycle on 20.08.2016 but his name was not transferred in the owner book of motorcycle. He had parked the motorcycle outside the house and same was stolen in the night by unknown person.

Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case only

Patna High Court Cr.Misc. No.39714 of 2018(2) dt.11-07-2018 2/2 on the basis of confessional statement made by Jay Kant Yadav and his self statement recorded by the police, except these two confessional statement, there is no incriminating material against petitioner to implicate him. It has further been submitted that petitioner is in custody since 11.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur, in connection with Andhratharhi P.S. Case No. 114 of 2016.
