JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Amnour P.S. Case No. 88 of 2019 registered for the offences punishable under Sections 379, 420 and 387 of the Indian Penal Code.
Petitioner happens to be Munsi of the informant, who is running a petrol pump and allegation against him is of defalcation of amount and for that he was earlier removed from the service and again he was allowed to work and further there is allegation against him of defalcation and he threatened the informant.
Submission of learned counsel for the petitioner is that there was some dues of wages against the informant and when he demanded he has been made accused in this case and he is ready to abide by any condition that may be imposed on

Heard learned APP also.
In view of above facts and circumstances, let petitioner surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Saran, Chapra, in connection with Amnour P.S. Case No. 88 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he will not in any way threat the informant and his family members and will not tamper with the evidence.
