1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Ramnagar Police Station Case No. 306 of 2024, disclosing offences under Section 309(4) of the BNS, 2023.
3. As per the prosecution case, on 11.07.2024, in the morning, while the informant was going towards his CSP Center on motorcycle with a bag containing Rs. 3,06,000/- and no sooner than he reached near village Bargajwa, three bikers on HF Delux motorcycle surrounded him pointed pistol upon him and snatched a bag containing cash, laptop, transaction register, memory card, ATM card and one Oppo Reno pro mobile with sim card no. 7761944680 inserted therein.
4. Learned counsel for the petitioner submits that the

No.84827 of 2024(4) dt.21-02-2025 2/3 petitioner is not named in the FIR and has not committed any offence in the manner alleged and during course of investigation, the petitioner's name transpired on the basis of physical appearance and a sum of Rs. 20,000/- was recovered which the petitioner was carrying for shradh ceremony of his mother who died some days before the date of occurrence on 06.07.2024. The petitioner is in custody since 16.07.2024 and after his implication in the present case, petitioner has been implicated in two other cases.

Regards being had to the submissions made by the parties and taking into consideration the fact that the petitioner has remained in custody for about more than six months and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner subject to the condition that he shall not repeat the similar offence in future.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran, in connection to the Ramnagar Police Station Case

8. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
