Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable u/s 341, 323, 354(B), 379, 427, 420, 504 and 506 read with 34 of the Indian Penal Code. As per prosecution case, the informant was getting her house constructed. In the meantime, the petitioners and the coaccused person holding lathi, danda and iron rod came and
Patna High Court CR. MISC. No.941 of 2023(2) dt.30-01-2023 2/3 started abusing the informant and also got the construction of her house stopped forcibly. On being asked the petitioner and the co-accused person started assaulting her. When her husband came to rescue her, he was assaulted by the petitioners with an iron rod causing injury. The petitioners tore her blouse and she became nude. The petitioner Krishna Kumar snatched ornaments made of silver and gold from informant. Accused Ravindra Mandal also snatched Rs. 10,000/- from the husband of the informant.
Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. There is land dispute between the parties. The informant sustained simple injury. The petitioner no. 1 is accused in one more case and the petitioner no. 2 has no criminal antecedent as stated in para 3 of the bail petition.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
Considering the aforesaid facts and circumstances of the case, as well as the fact that the injury being simple in nature, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs.
Patna High Court CR. MISC. No.941 of 2023(2) dt.30-01-2023 3/3 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhepura in connection with Chausa P.S. Case No. 216 of 2022, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This application stands allowed.
