The petitioner seeks bail in connection with Sikty P.S. Case No. 84 of 2019, registered under Sections 147, 148, 149, 224, 225, 341, 323, 324, 332, 333, 353, 307 and 504 of the Indian Penal Code.
The accusation is that on 10.06.2019, while informant along with other S.S.B personnel were deputed at the boarder of India-Nepal, at that time, some persons were seen entering inside the India keeping sacks on their heads, when they were chased, they started fleeing, but out of them one person was apprehended by commander Gaur Chand Ghosh. Thereafter, the associates of the caught hold person caused injury through Khukhari at Gaur Chand Ghosh and

The apprehended person disclosed his name Mustaque and he also disclosed the name of five persons, including the petitioner, as his associates. Learned counsel for the petitioner submits that petitioner was not apprehended on the spot, rather, his name come in confessional statement of co-accused Mustaque. The petitioner is in custody since 04.07.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria in connection with Sikty P.S. Case No. 84 of 2019. One of the sureties must be parents/close relative of the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
