The petitioner apprehends his arrest in Gandhi Maidan P.S. Case No.183/2017 registered under Sections 420, 120B/34 of the Indian Penal Code and Section 51/63 of Copy Right Act. The informant Nitesh Kumar Sah, the Manager of EIPR India Pvt. Ltd, being Investigating Officer, lodged the case after raiding the business premises of different persons and found that duplicate cartridges of HP Company were sold. Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The name of the petitioner was disclosed by Amar Kumar but nothing has been recovered from the possession of the petitioner. Taking into consideration the fact that no duplicate
Patna High Court Cr.Misc. No.40032 of 2018 (2) dt.11-07-2018 2/2 HP cartridges were recovered from the possession of the petitioner and the petitioner was not found selling any duplicate article, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-cum-Sub Judge-VI, Patna, in connection with Gandhi Maidan P.S. Case No.183/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
