The reason for non-appearance is mentioned in the petition and learned counsel for opposite party No.2 has no objection, as per instruction of his client, in allowing this restoration application and early hearing of the Cr. Revision Application. For substantial justice, the order of dismissal is hereby set aside subject to payment of cost of Rs. 100/- to be deposited in the Victim Compensation Fund.
