Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 6.4.2017 passed in Cr. Misc. No15283 of 2017 and further vide order dated 20.9.2017 passed in Cr. Misc. No.45268 of 2017.

Submission of the learned counsel for the petitioner is that his name transpired on the confessional statement of the coaccused and the other co-accused have already been granted bail by this Court, vide order dated 21.2.2018 passed in Cr. Misc. 2192 of 2018 and the petitioner is in custody since 16.11.2016. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

Patna High Court Cr.Misc. No.40438 of 2018 (2) dt.11-07-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge1st, Banka in connection with Trial No.208 of 2017 arising out of Amarpur (Fullidumar) P.S.Case no.472 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
